Welcome to Forward Health Management.
These Terms of Service (“Terms”) govern your access to and use of the Forward Health Management website, digital resources, educational materials, physical products, courses, and related services.
By visiting our website, creating an account, or purchasing a product or service from Forward Health Management (“FHM”), you agree to these Terms.
1. About Forward Health Management
Forward Health Management is a healthcare-adjacent lifestyle support company.
FHM provides structured education, lifestyle reinforcement, movement resources, digital materials, and physical wellness tools designed to support consistency outside of clinical settings.
Forward Health Management is not a medical provider.
FHM does not diagnose, treat, prescribe, provide medical clearance, or replace the care or advice provided by physicians, surgeons, physical therapists, dietitians, or other qualified healthcare professionals.
FHM supports care. It does not replace it.
2. Eligibility
You must be at least 18 years old to purchase or use FHM products and services.
By using our website, purchasing a product, or creating an account, you confirm that you meet this requirement.
3. Account Registration
Some FHM products and digital resources require an online account.
You agree to:
- provide accurate and complete information;
- keep your login information secure;
- not share your account credentials with unauthorized users; and
- notify FHM if you believe your account has been accessed without permission.
You are responsible for activity performed through your account unless otherwise required by law.
4. FHM Products and Services
FHM products may include:
- digital educational programs;
- online course access;
- e-books;
- audiobooks;
- onboarding resources;
- lifestyle-support materials;
- physical wellness equipment;
- movement education; and
- other resources offered by FHM.
The exact items included with a purchase will be identified on the applicable product or purchase page.
FHM may update, improve, replace, or modify its products, educational content, and services over time.
5. Purchases and Payments
All prices are listed in U.S. dollars unless otherwise stated.
Customers are responsible for:
- providing accurate billing information;
- providing an accurate shipping address;
- paying applicable taxes or fees; and
- reviewing the product information before completing a purchase.
Payments may be processed through third-party payment providers.
FHM does not directly control the payment-processing systems operated by those providers.
Failed Payments
A purchase is not considered complete until payment has been successfully processed.
If payment fails:
- the order is not considered a completed sale;
- physical inventory will not be released for fulfillment;
- paid onboarding will not begin; and
- paid digital access should not be activated until successful payment is confirmed.
Customers may be asked to update or resubmit payment information.
6. Current FHM Rollout Package
The current FHM rollout package is priced at $995 unless otherwise stated on the purchase page.
For refund and operational purposes, the current package is allocated as follows:
Digital Program and Resources — $495
The digital portion may include:
- online course access;
- digital education;
- onboarding materials;
- e-book access;
- audiobook access; and
- other digital resources included with the package.
Because access to these digital materials is provided after purchase, the $495 digital portion is nonrefundable.
Physical FHM Hardware — $500
The physical hardware portion of the current rollout package has a maximum refundable value of $500, subject to the return requirements described below.
Future FHM products or packages may have different pricing and refund allocations. Those terms will be identified at the time of purchase.
7. Digital Products and Access
Digital products and educational materials may become available immediately after a successful purchase.
Digital purchases and the digital portion of bundled FHM packages are final and nonrefundable once access has been provided, except where otherwise required by law.
Customers may not:
- copy FHM course materials for commercial use;
- redistribute digital materials;
- share paid account access;
- reproduce FHM content without permission; or
- sell, license, or distribute FHM educational materials to another person or organization.
8. Onboarding and Physical Activity
The FHM experience may include an onboarding period before the customer begins the physical movement portion of the program.
During onboarding, customers may receive access to educational materials, mindset resources, lifestyle-support content, and other digital resources.
The expected onboarding period may be approximately 30 days, but completion time may vary by customer.
Healthcare Provider Clearance
FHM does not determine whether a customer is medically ready to participate in physical activity.
Before the physical FHM hardware is released for use, the customer must:
- complete the required FHM onboarding steps; and
- confirm that their own healthcare provider has cleared them to participate in physical activity when clearance is required or directed.
FHM may ask the customer to confirm that clearance has been received.
FHM does not require customers to submit unnecessary medical records solely for this confirmation.
Customers should direct questions about surgery, pain, symptoms, physical limitations, medications, nutrition, or medical readiness to their healthcare provider.
9. Hardware Fulfillment and Shipping
Physical FHM hardware is not automatically released simply because a certain number of days have passed after purchase.
Hardware is released for fulfillment after the required onboarding process and applicable customer confirmation of healthcare-provider clearance are completed.
FHM will verify shipping information before shipment.
Customers are responsible for providing a complete and accurate shipping address.
Standard Outbound Shipping
For the current rollout package, Forward Health Management covers standard outbound shipping to the customer unless otherwise stated at checkout.
Additional charges may apply for special shipping requests, expedited delivery, international shipping, or other circumstances where applicable.
10. Returns and Refunds
Physical Hardware
Customers may request to return eligible FHM hardware within 60 days of confirmed delivery.
Hardware may be opened and reasonably used during the return period.
To qualify for a refund, the hardware must:
- be complete;
- be returned with all required parts and accessories;
- not have damage beyond normal inspection or reasonable use; and
- be returned according to FHM’s return instructions.
FHM will inspect returned hardware before approving a refund.
For the current $995 rollout package, the maximum refund for the physical hardware portion is $500.
The $495 digital portion remains nonrefundable.
Return Shipping
Customers are responsible for return shipping when choosing to make a voluntary return.
FHM does not charge a restocking fee.
If hardware arrives damaged, defective, incorrect, or the return results from an FHM fulfillment error, customers should contact FHM before returning the product.
When appropriate, FHM will provide instructions and cover the applicable return or replacement shipping costs.
Refund Method
Approved refunds will generally be issued to the original payment method when possible.
Processing times may vary depending on the customer’s bank, card issuer, PayPal, or other payment provider.
Customers should review the separate Forward Health Management Refund & Return Policy for additional instructions.
11. Duplicate Orders and Order Corrections
If FHM identifies what appears to be a duplicate order, we may temporarily hold fulfillment while confirming the customer’s intent.
Customers should contact FHM as soon as possible if:
- the wrong product was purchased;
- the wrong email address was entered;
- the shipping address is incorrect; or
- an order appears to have been placed more than once.
FHM may update customer or shipping information before shipment when appropriate.
Once an order has shipped, options for correcting the delivery may depend on the shipping carrier.
12. Medical and Health Disclaimer
Forward Health Management does not provide medical treatment or medical advice.
Nothing provided by FHM should be interpreted as:
- medical diagnosis;
- medical treatment;
- surgical guidance;
- medical clearance;
- physical therapy;
- individualized nutritional direction;
- prescription advice; or
- a replacement for professional healthcare.
Individual results and experiences vary.
Customers should follow the care plan and recommendations established by their qualified healthcare professionals.
If a customer experiences pain, unusual symptoms, or a medical concern, the customer should stop the activity when appropriate and contact a qualified healthcare professional.
13. Intellectual Property
Unless otherwise stated, FHM owns or has rights to the content made available through its website, products, courses, videos, documents, branding, educational materials, and other resources.
This includes, where applicable:
- trademarks;
- logos;
- videos;
- written materials;
- course content;
- graphics;
- product designs;
- photographs;
- audio materials; and
- digital downloads.
Purchasing an FHM product does not transfer ownership of FHM intellectual property to the customer.
Customers receive a limited right to use purchased materials for their own personal use.
Written permission from FHM is required before FHM materials may be reproduced, sold, distributed, licensed, or used commercially.
14. Appropriate Use
Customers agree not to:
- use FHM services for unlawful or fraudulent purposes;
- interfere with the operation or security of the FHM website;
- attempt to gain unauthorized access to FHM systems;
- misuse another person’s account;
- copy or distribute protected FHM content without permission; or
- use FHM products or services in a way that violates applicable law.
15. Privacy
FHM collects and uses customer information according to the Forward Health Management Privacy Policy.
Information may be used to:
- process orders;
- deliver products;
- provide digital access;
- provide customer support;
- manage customer accounts;
- communicate important service information; and
- improve FHM products and operations.
Customers should review the FHM Privacy Policy for additional information.
16. Third-Party Services
FHM may use outside service providers for functions such as:
- payment processing;
- website hosting;
- course delivery;
- video hosting;
- email services;
- shipping;
- analytics; and
- other business operations.
Use of some third-party services may also be subject to the terms and privacy policies of those providers.
17. Suspension or Termination
FHM may suspend or terminate access to its services when reasonably necessary, including when a user:
- violates these Terms;
- engages in fraudulent activity;
- attempts unauthorized access;
- misuses FHM intellectual property; or
- engages in conduct that threatens FHM’s systems, users, or business operations.
Any refund rights following termination will be determined according to applicable law and the FHM Refund & Return Policy.
18. Disclaimers
FHM products, services, website content, and digital resources are provided on an “as is” and “as available” basis to the extent permitted by law.
FHM does not guarantee a specific:
- amount of weight loss;
- medical outcome;
- physical result;
- fitness result;
- behavioral outcome; or
- lifestyle result.
Results depend on many factors that vary between individuals.
19. Limitation of Liability
To the fullest extent permitted by applicable law, Forward Health Management will not be responsible for indirect, incidental, special, or consequential damages arising from the use or inability to use FHM products or services.
Nothing in these Terms is intended to limit rights or remedies that cannot legally be limited or excluded.
20. Governing Law
These Terms will be governed by the laws of the state in which Forward Health Management is legally organized or otherwise designated in its final approved Terms, without regard to applicable conflict-of-law principles.
21. Changes to These Terms
Forward Health Management may update these Terms from time to time.
When material changes are made, the updated version will be posted on the FHM website with a revised effective date.
Continued use of FHM products or services following an update constitutes acceptance of the revised Terms to the extent permitted by law.
